Terms & Conditions

These terms apply to your use of the FAN CAVE website and purchases from FAN CAVE, an independent art retailer operating from Queensland, Australia. By using the site or placing an order, you agree to these terms.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

You must be legally able to enter into a purchase contract and provide complete, current and accurate order, contact and delivery information. An order is an offer to purchase. We may accept or decline it, including where a product is unavailable, information is incomplete, fraud is suspected or a genuine pricing or listing error has occurred.

If we cancel an order after payment, we will refund the affected amount. We may correct obvious pricing, currency, tax or product information errors to the extent permitted by law and will contact you where an accepted order is materially affected.

Prices, currencies, taxes, delivery charges and available promotions are shown at the relevant stage of the site or secure checkout. Currency availability and final charges can depend on delivery destination.

Our canvases are made to order. Availability can change before production begins. Product photographs and room mockups are illustrative; screen settings, crop, scale and normal printing variation may affect appearance. This does not limit your rights where goods are materially misdescribed or defective.

A custom-size or custom-artwork enquiry is not an order. Pricing, specifications, artwork and production timing are agreed separately. Once you approve the quote, artwork or specification and production begins, cancellation or change-of-mind is not available, except where FAN CAVE agrees otherwise or the law requires a remedy.

If you provide or upload an image, artwork, text or other content for a custom request, you warrant that you own it or have every permission and licence needed for FAN CAVE to reproduce, crop, modify as instructed, print and fulfil the order. You are responsible for third-party copyright, trademark, privacy, publicity and likeness permissions.

You grant FAN CAVE and our production and fulfilment partners a limited, non-exclusive licence to use that content only to assess, process, produce and fulfil your request and provide related support. You retain ownership of your original content. We may refuse, pause or cancel content we reasonably believe infringes rights or breaches law, with an appropriate refund where applicable.

Discounts and promotional codes are subject to their stated eligibility, period, exclusions and combination rules. Unless expressly stated, offers cannot be combined. We may correct or withdraw an offer affected by a genuine error, misuse or unlawful activity, subject to applicable law.

You must not interfere with the site, attempt unauthorised access, scrape it unlawfully, distribute malicious code, misuse another person's details, or use the site or its content for unlawful purposes.

FAN CAVE branding, site design, text and original creative contributions are owned by or licensed to FAN CAVE, subject to third-party rights. No transfer of intellectual property occurs when you view the site or buy a canvas. Third-party rights are addressed in our Intellectual Property & Non-Affiliation Notice.

We use specialist payment, hosting, production, delivery, fraud-prevention and other service providers to operate the store and fulfil orders. Their services may be subject to additional terms, but FAN CAVE remains your point of contact for your order.

To the maximum extent permitted by law, FAN CAVE is not liable for indirect or consequential loss that was not reasonably foreseeable. This limitation does not apply where liability cannot lawfully be excluded or limited, and is expressly subject to non-excludable Australian Consumer Law rights.

You are responsible for reasonably foreseeable loss caused by your unlawful misuse of the site, your infringement of third-party rights in content you provide, or your material breach of these terms. This does not make you responsible for loss caused by FAN CAVE and does not limit any mandatory consumer right.

These terms are governed by the laws of Queensland, Australia. Mandatory consumer protections and any rights you have under the law of your location remain preserved. If a provision is invalid or unenforceable, the remaining provisions continue to apply.

We may update these terms prospectively. The version applying to an accepted order is the version in effect when that order was placed, unless the law requires otherwise. Contact us through the FAN CAVE contact page with questions.
